Film-maker sues Earthlink for email hold-up

NEWS US Internet Service Provider (ISP) Earthlink is being sued for $7m for allegedly cutting off a customer's email account. The customer, New York film maker Peter Hall, is claiming damage to his business, mental distress, libel, negligence, breach of contract and violation of the Electronic Communications Privacy Act. The case relates to events this time last year when Earthlink shut down Hall's email account because it believed he was using it to send spam mail. In a statement, Hall's lawyer claimed ISPs have a duty to either send emails to the correct address or return them to the sender.
