3Com wins bitter legal battle with rival

'Stop producing modems...'

NEWS 3Com has won an injunction banning the sale and development of 26 of rival Xircom's key products. The networking giant took the Intel subsidiary to court over alleged patent infringement. A federal District Court ruled that 26 of Xircom's products are likely to infringe technology patented by 3Com. Judge Tena Campbell then banned the manufacture, sale and use of all 26 products including Xircom's RealPort and RealPort 2 modems. In response, Intel has filed a motion to suspend the injunction until an appeal can be heard. An Intel spokesman said: "This is only a preliminary injunction so it is short term and it does not resolve the real litigation. We are filing an appeal." However, he played down the case, saying that it pre-dated Intel's acquisition of Xircom. "RealPort is a strong performer but it is past its technical maturity. We acquired Xircom for its mobile technology and the success of RealPort has been instrumental in that," he added. The injunction will remain in place until the case has been resolved.
