Dmitri lawyers fail in Adobe hack appeal

Sklyarov can get into code but not out of trouble...

NEWS A US judge has dismissed an appeal by the lawyers of Russian hacker Dmitri Sklyarov looking to overturn a lawsuit which alleges he breached the terms of the Digital Millennium Copyright Act (DMCA). Sklyarov is accused of hacking the code of Adobe's copyrighted e-books software and his employer, Russian knowledge management software firm Elcomsoft, is also named in a suit relating to the subsequent distribution of the code. Sklyarov's legal team, which also represents his employer, tried to get the case overturned by claiming any wrongdoing is beyond US jurisdiction because the code was freely distributed on the internet. However, the federal judge denied the motion and said software was offered for sale through a US-based web server. Lawyers representing the Russian programmer originally filed a complaint against the DMCA in January this year. The case continues.
