Microsoft lawyers accuse Sun of confusion

NEWS Microsoft is accusing Sun Microsystems of trying to muddy the issue in its ongoing Java court case. The Seattle giant's lawyers claim Sun is accusing it of breaking both copyright infringment and breach of contract laws. But, they say, this is merely plunging the case into confusion because the penalties under copyright infringement are totally different from those under breach of contract. To make the situation even worse, the lawyers claim that when US District Judge Ronald Whyte issued his initial ruling in favour of Sun last May, he only did so under copyright infringement laws. Microsoft's legal team now says that until the charges are clarified, the May injunction to ensure all Microsoft are 100 per cent Java, cannot be upheld. The case continues.
